Wickens, Trevor

Trevor Wickens was convicted in February 1991 of murder and received a sentence of life imprisonment.

The CCRC received an application for review of the conviction in October 1999.

At trial, key witnesses for the prosecution had given evidence which placed the victim’s death in a particular window of time.

The prosecution’s expert pathologist did not give an estimated time of death and no pathologist was called for the defence.

During review, the CCRC obtained new expert pathology evidence indicating that the victim’s death within the window of time proposed by the prosecution’s witnesses was unlikely.

The CCRC concluded that if known at trial, this new information could have affected the jury’s verdict.

The CCRC referred the conviction in May 2002.

The Court of Appeal quashed the conviction in June 2003.
