Waters, Colin

Colin Waters was convicted in July 1994 of murder and received a sentence of life imprisonment.

The CCRC received an application for review of the conviction in September 1998.

The victim in this case was Mr Waters’ baby son.

During review, the CCRC obtained new expert pathological evidence indicating that the victim may have died at an earlier time than that contended by the prosecution at trial.

At this earlier time, the victim’s mother was present. It had been the prosecution’s case that the victim had been killed when Mr Waters was alone with him.

The CCRC referred the conviction on this basis in October 2003.

The Court of Appeal upheld the conviction in January 2006.
