Tonner, Christopher

Christopher Tonner was convicted in March 2005 of robbery and assault with intent to resist arrest.

Mr Tonner received a sentence of six years’ imprisonment and was returned to custody for nine months under the Powers of the Criminal Courts (Sentencing) Act 2000, arising from early release following a conviction in October 2002.

The CCRC received an application for review of Mr Tonner’s sentence in January 2009.

The CCRC found that when sentencing Mr Tonner to nine months’ imprisonment for the unexpired term of his previous sentence, the judge failed to take account of the period of 232 days that Mr Tonner had spent in custody as a result of his licence recall.

The CCRC concluded that there was a real possibility the Court of Appeal would determine that the sentence should be adjusted and/or the overall sentence should be reduced.

The CCRC referred the sentence in April 2009.

The Court of Appeal reduced the sentence in May 2009.
