Pickavance, Kenneth

Kenneth Pickavance was convicted in April 2002 of driving without due care and attention, failing to stop after an accident, and failing to report an accident.

Mr Pickavance received a fine of £250 and was ordered to pay £175 in costs. He also received five penalty points on his licence.

The CCRC received an application for review of the conviction in June 2002.

Mr Pickavance had been convicted after he had failed to accede to a cyclist on a roundabout causing the cyclist to ride into Mr Pickavance’s car and, according to the cyclist’s statement, misaligning the handlebars of his bicycle.

Mr Pickavance claimed he did not realise there had been an accident. He had heard the cyclist shout at him but had continued, believing it to be road rage.

Following review, the CCRC concluded that it could not be presumed that Mr Pickavance knew an accident had taken place.

The CCRC referred the convictions for failing to stop after an accident and failing to report an accident in November 2002.

The Crown Court quashed the referred convictions in February 2003.
