Mr FE

Mr FE appeared at Caernarfon Crown Court in April 2012 charged with rape. He pleaded not guilty but was convicted and sentenced to five years’ imprisonment.

Mr FE sought leave to appeal. His application for leave to appeal was heard and dismissed by the full court in November 2012. He applied to the CCRC in July 2014.

During review, the CCRC obtained new witness evidence that added support to Mr FE’s claim that the complainant had uttered words during a sexual encounter which indicated consent. This evidence would have added significant support to Mr FE’s defence at trial.

Consequently, the CCRC concluded that there was a real possibility the Court of Appeal would consider Mr FE’s conviction to be unsafe.

The CCRC referred the conviction in October 2015.

The Court of Appeal quashed the conviction in April 2016.
