Mr EC

Mr EC pleaded not guilty but was convicted of rape at Birmingham Crown Court in January 2009 and sentenced to five years’ imprisonment. Mr EC was also indefinitely placed on the sex offenders’ register.

He tried to appeal against the conviction but the appeal was dismissed in 2010. He applied to the CCRC for a review of his case in August 2010.

During review, the CCRC obtained fresh material from West Midlands Police which had not been seen by the trial or appeal courts.

This material revealed that the complainant had previously made a demonstrably false complaint of serious sexual assault against a stranger.

The CCRC concluded that the Court of Appeal may consider that this material impacted the credibility of the complainant’s allegation against Mr EC and thereby on the safety of the conviction.

The CCRC referred the conviction in September 2013.

The Court of Appeal quashed the conviction in March 2014.
