Mr DC

Mr DC was convicted in July 2004 of rape and received a sentence of five years’ imprisonment.

The CCRC received an application for review of the conviction in December 2005.

A major area of dispute at trial had been whether there had been consensual oral sex between Mr DC and the complainant.

It was the defence case that penetrative sex followed consensual oral sex. This was denied by the complainant.

During review, the CCRC obtained new evidence that supported the defence’s case.

Whilst this did not remove the possibility that the complainant had been raped following consensual oral sex, the complainant had denied at trial that consensual oral sex had taken place.

Given this, the new evidence raised questions over the credibility of the rest of the complainant’s account.

The CCRC concluded that this gave rise to a real possibility that the Court of Appeal would find Mr DC’s conviction unsafe.

The CCRC referred the conviction in August 2010.

The Court of Appeal quashed the conviction in February 2011.
