Mr DB

Published:

Mr DB was convicted in June 2005 of indecent assault and rape. Mr DB received a sentence of 12 years’ imprisonment.

The CCRC received an application for review of the conviction in September 2008.

During review, the CCRC obtained fresh evidence that cast substantial doubt on the credibility of the complainant. This included social services material that had not been disclosed at trial.

The CCRC concluded that had this evidence been presented at trial the jury may have reached a different verdict, giving rise to a real possibility the Court of Appeal would find Mr DB’s conviction unsafe.

The CCRC referred the conviction in January 2010.

The Court of Appeal upheld the conviction in November 2010.
