Mr CR
Mr CR was convicted in October 2004 of rape and indecent assault. Mr CR received a sentence of seven years’ imprisonment.
The CCRC received an application for review of the conviction in January 2007.
During review, the CCRC obtained fresh expert evidence confirming Mr CR had a genital abnormality that the complainant might have been expected to notice had the alleged assaults taken place.
In cross-examination at trial, the complainant stated that he had seen Mr CR’s genitalia and that there was no abnormality.
The CCRC concluded that there was a real possibility the Court of Appeal would consider that had the jury had the opportunity to consider this evidence, it might have impacted on their assessment of the complainant’s credibility.
The CCRC referred the conviction in June 2009.
The Court of Appeal quashed the conviction in December 2009.
