Mr CQ

Mr CQ was convicted in February 2006 of rape and assault by penetration. Mr CQ received a sentence of nine years’ imprisonment.

The CCRC received an application for review of the conviction in September 2007.

During review, the CCRC obtained new evidence that cast substantial doubt on the complainant’s credibility as a witness of truth.

Had this evidence been available at trial and been adduced during cross-examination of the complainant and/or by the calling of witnesses, the jury may have reached a different verdict.

There was consequently a real possibility the Court of Appeal would consider the complainant’s evidence to be so unreliable as to make the conviction unsafe.

The CCRC referred the conviction in June 2009.

The Court of Appeal quashed the conviction in March 2010.
