Mr CO
Mr CO was convicted in March 2006 of rape and received a discretionary life sentence with a tariff of five years and six months.
The CCRC received an application for review of Mr CO’s sentence in November 2008.
Following review, the CCRC concluded the sentencing judge had failed to credit Mr CO with time spent on remand.
The judge should have deducted the time spent on remand from the sentence or alternatively stated why he was not taking the time spent on remand into account.
The CCRC referred the sentence in March 2009.
The Court of Appeal reduced the sentence in July 2009.
