Mr CG

Mr CG was convicted in December 2004 of indecent assault and received a sentence of 12 months’ imprisonment.

The CCRC received an application for review of the conviction in August 2006.

During review, the CCRC obtained new information that the complainant in this case had, post-trial, made an allegation of rape against another individual but had subsequently admitted that this allegation was untrue.

A further allegation against a separate individual resulted in a trial in which the defendant was acquitted.

The CCRC considered that there was a real possibility that the Court of Appeal would regard these matters as having a sufficiently significant effect on the complainant’s credibility as a witness as to render Mr CG’s conviction unsafe.

The CCRC referred the conviction in August 2007.

The Court of Appeal quashed the conviction in May 2008.
