Mr BV
Mr BV was convicted in March 2004 of rape and indecent assault. Mr BV received a sentence of six years’ imprisonment.
The CCRC received an application for review of the conviction in June 2005.
During review, the CCRC obtained fresh expert evidence relating to the level of alcohol in the complainant’s bloodstream at the time of the alleged offences and the likelihood of the complainant having slept through sexual activity as was alleged.
These were key issues at trial and as such the CCRC considered that the new evidence could have affected the view the jury took over the issue of consent.
The CCRC referred the conviction in February 2007.
The Court of Appeal quashed the conviction in July 2007.
