Mr BH
Mr BH was convicted in October 2003 at Liverpool Crown Court of rape and indecent assault. Mr BH received a sentence of five years’ imprisonment.
The CCRC received an application for review of the conviction in June 2004.
Following review, the CCRC concluded that there had been a failure to disclose to the defence complaints of gross indecency and harassment made to the police by the complainant against another individual.
The complainant’s close friend, who had been tendered to corroborate the complaint, had in effect told police that this other complaint had been invented. The complaint had been marked as “no crime” in police records.
Given the circumstances of the allegation made against this individual and the manner in which the incident was resolved by the police, the CCRC took the view that it was capable of either assisting the defence or undermining the prosecution case against Mr BH.
The CCRC referred the conviction in August 2005.
The Court of Appeal quashed the conviction in January 2006.
