Mr BC

Mr BC was convicted in April 2002 of rape and received a sentence of eight years’ imprisonment.

The CCRC received an application for review of the conviction in October 2003.

During review, the CCRC obtained new evidence that the complainant’s account at trial of injuries caused by Mr BC had been significantly enhanced in subsequent applications to the Criminal Injuries Compensation Authority (CICA), resulting in increased claims for compensation.

Some claims made by the complainant in their CICA application were untrue.

The CCRC considered that in this case, the jury’s verdict depended on their belief in the credibility of the complainant and that the discrepancies and inconsistencies in accounts undermined that credibility.

The CCRC referred the conviction in February 2005.

The Court of Appeal quashed the conviction in November 2005.
