Mr AZ

Mr AZ was convicted in January 2003 of rape and received a sentence of four years’ imprisonment.

The CCRC received an application for review of the conviction in July 2003.

During review, the CCRC obtained new evidence indicating that the complainant had made very similar allegations to those that featured in this case in two previous complaints to police in different locations.

The complainant had admitted to police in one of these previous complaints that her allegations had been untrue. In the second case the police had recorded the complainant as “no crime”.

The complainant had also made similar allegations during Industrial Tribunal proceedings for unfair dismissal.

This material had not been disclosed to Mr AZ’s defence and the CCRC concluded that it had the potential to undermine the reliability and credibility of the complainant.

The CCRC referred the conviction in November 2004.

The Court of Appeal quashed the conviction in March 2005.
