Mr AW

Mr AW was convicted in March 2016 at Liverpool Crown Court of assault by penetration and rape. He was sentenced to a total of seven years’ imprisonment.

The basis of the prosecution case was the complainant’s account of the events that took place. Mr AW denied the offences, and the defence argued the complainant was an unreliable witness.

The CCRC received an application for review of the conviction in August 2020.

Following review, the CCRC concluded that there was fresh evidence that undermined the credibility and/or reliability of the complainant.

Consequently, there was a real possibility the Court of Appeal would find the conviction unsafe.

The CCRC referred the conviction in May 2024.
