Mr AN
Mr AN was convicted in February 2002 of rape and assault occasioning actual bodily harm. Mr AN received a sentence of 42 months’ imprisonment.
The CCRC received an application for review of the conviction in September 2002.
At trial, the prosecution’s case against Mr AN was supported by an expert forensic witness.
During review, the CCRC commissioned a fresh expert forensic report which found that the conclusions of the trial expert could not be reliably justified.
In addition, there was new evidence suggesting that there may have been cross-contamination or confusion between intimate forensic swabs of the victim.
The CCRC referred the conviction in November 2003.
The Court of Appeal quashed the conviction in May 2005.
