Mr AK

Mr AK was convicted in December 1998 of rape and received a sentence of five years’ imprisonment.

The CCRC received an application for review of the conviction in February 2000.

Mr AK had been convicted of the rape of his wife whilst they were going through a separation.

The CCRC’s investigations revealed new evidence that showed the complainant had lied under oath in subsequent civil proceedings.

The complainant had also lied in making claims for invalidity benefit when she said that she had been disabled by assaults committed by Mr AK.

The CCRC concluded that as Mr AK’s conviction ultimately depended upon the reliability of the evidence given at trial by the complainant, there was a real possibility the jury, had they been aware of this new evidence, might not have reached the same verdict.

The CCRC referred the conviction in October 2001.

The Court of Appeal quashed the conviction in July 2005.
