Mr AF

Mr AF was convicted in July 1982 of rape and assault occasioning actual bodily harm. Mr AF received a sentence of five years’ imprisonment.

The CCRC inherited an application for review of the conviction from the Home Office in March 1997.

An investigation revealed that the complainant had made previous allegations of sexual offences against Mr AF which had been investigated by the police but which were subsequently withdrawn by the complainant.

This had not been known at trial. The CCRC considered that had it been known, it may have had a material effect on the jury’s assessment of the victim’s credibility and their verdict.

The CCRC referred the conviction in December 2000.

The Court of Appeal upheld the conviction in May 2002.
