Mr AE

Mr AE was convicted in July 1986 and December 1986 of rape and assault. Mr AE received a sentence of life imprisonment.

The CCRC received an application for review of the conviction in June 1998.

At trial, the prosecution had produced disputed confession evidence from police interview records.

During investigation, the CCRC obtained new “electrostatic detection apparatus” (ESDA) evidence which gave support to the defence’s allegation that the police interview records had been to some degree falsified.

The CCRC considered that had the ESDA reports been available at the trial, the defence would have sought to have the alleged confessions excluded and therefore the jury may not have arrived at the same conclusion.

The CCRC referred the conviction in June 2000.

The Court of Appeal upheld the conviction in January 2002.
