Mr AA

Mr AA was convicted in July 1997 of attempted rape, indecent assault, and intimidating a witness. Mr AA received a sentence of eight years’ imprisonment.

The CCRC received an application for review of the conviction in March 1999.

Following investigation, the CCRC concluded that there were significant deficiencies in the investigation of the case, at Mr AA’s trial, and in the trial judge’s summing up.

Amongst other concerns, the police had failed to conduct an identification parade in circumstances in which they were under a duty to do so.

The trial judge also failed to direct the jury on the weight to be given to witness identification evidence in light of the failure to hold an identification parade, and the judge gave an inadequate warning about the dangers of mistaken identification.

The CCRC referred the conviction in May 1999.

The Court of Appeal quashed the conviction in July 1999 and ordered a retrial.
