McKenzie, David

David McKenzie was convicted in October 2010 of robbery and received a sentence of imprisonment for public protection with a minimum term of four years.

The CCRC received an application for review of Mr McKenzie’s sentence in October 2014.

During review, the CCRC considered that in this case it appeared that there was no consideration by either defence counsel or the judge as to whether an extended sentence could be more appropriate than a sentence of imprisonment for public protection (IPP).

Taking into account other cases of a similar nature, the CCRC concluded that there was a real possibility the Court of Appeal would find that the imposition of an IPP in Mr McKenzie’s case was wrong in principle and manifestly excessive.

The CCRC referred the sentence in November 2015.

The Court of Appeal upheld the sentence in April 2016.
