Maguire, Christopher

Christopher Maguire was convicted in November 1997 of burglary, theft, and attempted burglary. Mr Maguire received a sentence of three years’ detention in a young offenders’ institute.

The CCRC received an application for review of Mr Maguire’s sentence in August 1998.

Following review, the CCRC concluded that the sentencing judge in this case had been presented with an incorrect antecedent history for Mr Maguire and so the judge has been misled as to Mr Maguire’s previous convictions.

At the first-time appeal, the judge had also made reference to Mr Maguire’s history of offending in his refusal to allow an appeal.

The CCRC considered that the error in the antecedents was prejudicial to Mr Maguire at the time of his appeal as well as at his original sentencing.

The CCRC referred the sentence in November 1998.

The Court of Appeal reduced the sentence in April 2006.
