Lomey, John

John Lomey was convicted in June 1984 of aggravated burglary with intent to do grievous bodily harm, assault, and criminal damage to property.

Mr Lomey received a sentence of life imprisonment.

The CCRC received an application in June 2001 for review of the life sentence attached to one of Mr Lomey’s convictions.

During review, the CCRC obtained new expert psychiatric evidence indicating that Mr Lomey had been subject to undiagnosed psychiatric vulnerabilities at the time of the offences.

The CCRC considered that Mr Lomey should therefore have been subject to a hospital order under section 37 of the Mental Health Act 1983, rather than a discretionary life sentence.

The CCRC referred the sentence in July 2003.

The Court of Appeal upheld the sentence in October 2004.
