James, Philip

Philip James was convicted in January 2003 of escape and assault occasioning actual bodily harm.

Mr James received a sentence of two years’ imprisonment for escape (reduced on appeal to 15 months) and three months’ imprisonment for assault.

Both terms were to be served consecutive with a return to custody for 386 days under section 116 of the Powers of Criminal Courts (Sentencing) Act 2000.

The CCRC received an application for review of the sentence in December 2003.

Following review, the CCRC concluded that the sentencing judge had failed to properly credit Mr James for time served after he was administratively recalled to prison due to breach of licence, having previously been released on licence before completing the sentence for an earlier offence.

The CCRC referred the sentence in December 2003.

The Court of Appeal reduced the sentence in February 2004.
