Heibner, Errol

Errol Heibner was convicted in November 1976 of murder and received a sentence of life imprisonment.

The CCRC received an application for review of the conviction in October 2007.

Mr Heibner was convicted partly on the basis of a confession statement.

Following review, the CCRC concluded the confession may have been incorrectly admitted and/or inadequately dealt with at trial.

In particular, the CCRC considered that the judge’s direction at trial that the jury should consider the “truth” of the confession statement may have been inappropriate.

In addition, the CCRC obtained new evidence which, if it had been presented at trial, may have affected the credibility of a key prosecution witness.

The CCRC referred the conviction in March 2010.

The Court of Appeal upheld the conviction in January 2014.
