Guney, Erkin
Erkin Guney was convicted in July 1996 of possessing a controlled substance of Class A with intent, possessing a firearm without a certification, and possessing ammunition without a certificate.
Mr Guney received a sentence of 14 years’ imprisonment.
The CCRC received an application for review of the conviction in June 1998.
During investigation, the CCRC became aware of information which was not available to either the defence or prosecution at the time of the trial or appeal.
This information amounted to evidence that substantially discredited the integrity of police officers who had played an important part in gathering intelligence in the case.
The CCRC considered that had the material been available at the time of trial, it should have been brought to the attention of the trial judge.
The material was relevant to matters considered by the judge at an ex-parte hearing prior to Mr Guney’s trial, and might have caused the judge to have come to a different conclusion at that hearing.
The CCRC referred the conviction in July 2002.
The Court of Appeal quashed the conviction in May 2003.
