Gilbert, Clemens
Clemens Gilbert was convicted in July 1994 of murder and received a sentence of life imprisonment.
The CCRC received an application for review of the conviction in July 1999.
Mr Gilbert had killed his common-law wife, the case being defended on the basis of provocation.
Whilst there had been indications that Mr Gilbert had been suffering from schizophrenia at the time of the offence, this diagnosis was rejected by several doctors who examined Mr Gilbert pre-trial.
During review, the CCRC obtained fresh medical evidence that Mr Gilbert had indeed been subject to paranoid schizophrenia pre-dating the offence.
The CCRC referred the conviction on the basis of diminished responsibility in August 2002.
The Court of Appeal upheld the conviction in July 2004.
