Davis, Joseph

Joseph Davis was convicted in June 2006 of wounding with intent to cause grievous bodily harm and received a sentence of imprisonment for public protection with a minimum term of one year and 210 days.

The CCRC received an application for review of the sentence in April 2010.

Following conviction, Mr Davis had been transferred from prison to hospital with restriction under the Mental Health Act.

During review, the CCRC obtained fresh expert evidence indicating that Mr Davis was suffering from psychiatric vulnerabilities at the time of his sentencing and that he continued to meet the criteria for a hospital order.

Therefore, in line with established sentencing principles, the CCRC referred Mr Davis’s sentence in November 2012 on the basis that there was a real possibility the Court of Appeal would substitute a hospital order for the sentence of imprisonment for public protection.

In June 2013, the Court of Appeal substituted the sentence of imprisonment for public protection with a hospital order.
