Cole, Kevin

Kevin Cole was tried at Preston Crown Court in March 1998 for murder and for wounding with intent to cause grievous bodily harm. He pleaded not guilty but was convicted and sentenced to life imprisonment.

He was refused leave to appeal in 1999 and applied to the CCRC in February 2008.

The CCRC decided to refer the conviction to the Court of Appeal because it considered that new evidence capable of undermining identification evidence heard at trial raised a real possibility that the Court would quash the conviction.

Amongst other matters, there had been breaches of the Police and Criminal Evidence Act 1984 during identification procedures. Disclosure failures had also deprived Mr Cole of effective legal advice.

The CCRC referred the conviction in April 2012.

The Court of Appeal upheld the conviction in July 2013.
