Derek Borrows was convicted in January 1999 of wilful obstruction of the highway and received a one year conditional discharge and a £50 costs order.

The CCRC received an application for review of the conviction in March 2000.

Mr Borrows had been inconvenienced by how vehicles had been parked by workmen who were carrying out repairs close to his flat.

He used his own vehicle to block in the workmen’s vehicles, leading to his prosecution under the Highways Act.

During review, the CCRC considered new evidence that the place where Mr Borrows had parked his car was not a public highway and, consequently, the offence was not made out.

The CCRC referred the conviction in June 2001.

The Crown Court quashed the conviction in September 2001.
