Mr EM

Mr EM was convicted of rape following a trial at the Inner London Crown Court in July 2010. He was sentenced to six and a half years’ imprisonment.

Mr EM was refused leave to appeal shortly after the trial. He applied to the CCRC in March 2012.

Following review, the CCRC concluded there was a real possibility that the Court of Appeal would find Mr EM’s conviction unsafe on the basis of new mobile phone evidence. This evidence was relevant to the issues of consent and the credibility of the complainant.

In addition, the CCRC identified procedural errors on the part of the police, prosecution and defence that arguably rendered the trial process unfair.

The CCRC referred the conviction in July 2014.

The Court of Appeal later upheld the conviction.
