Mr DN (2/2)

Mr DN was convicted in November 2006 and January 2008 (at a retrial) of rape and sexual assault. Mr DN received a sentence of eight years’ imprisonment.

The CCRC received an application for review of the conviction in September 2012.

The CCRC had previously referred the conviction back to the Court of Appeal in November 2011. The referral had been on the basis of evidence that potentially undermined the credibility of the complainant. The conviction was upheld in July 2012.

During this review, the CCRC obtained fresh expert evidence that further impacted the credibility of the complainant’s evidence at trial and affected the significance attributable to the medical evidence that had been presented at trial.

The CCRC referred the conviction in March 2014.

The Court of Appeal upheld the conviction in May 2015.
