Stojanovic, Tomislav

Tomislav Stojanovic pleaded not guilty but was convicted of common assault at Sussex Central Magistrates Court in January 2008. He was sentenced to 190 hours Community Service and ordered to pay £100 compensation and £410 costs.

He appealed to Lewes Crown Court but his appeal was dismissed. He applied to the CCRC for a review of his case in March 2011.

The offence concerned an altercation between the complainant and three other men, including Mr Stojanovic, in which the complainant was pushed over.

Mr Stojanovic admitted being one of the three men but denied pushing the complainant.

Mr Stojanovic was identified by the complainant as his attacker following a video procedure and this was the only identification evidence against Mr Stojanovic.

Other witnesses provided evidence that an assault had occurred but they did not identify Mr Stojanovic.

During review, the CCRC obtained new witness evidence that cast significant doubt on the prosecution’s case that Mr Stojanovic was responsible for the push.

The CCRC referred the conviction in April 2013.

The Crown Court quashed the conviction in May 2013.
