Mr DD

Mr DD was convicted in October 2003 of rape and indecent assault. Mr DD received an extended sentence of 13 years’ imprisonment (a custodial term of eight years with an extension period of five years) for rape, and five years’ imprisonment concurrent for indecent assault.

The CCRC received an application for review of Mr DD’s sentence in May 2009.

The application concerned the sentence of five years’ imprisonment for indecent assault.

During review, the CCRC considered new legal argument that the sentence imposed for this offence should not have exceeded the maximum sentence for unlawful sexual intercourse, as well as new information indicating that the original sentence had been based upon an erroneous factual basis.

The CCRC referred the sentence in September 2010.

The Court of Appeal reduced the sentence in March 2011.
