Mr CF

Mr CF was convicted in April 2005 of rape and received a sentence of six years’ imprisonment plus two years’ extended licence pursuant to section 85 of the Powers of Criminal Courts (Sentencing) Act 2000.

The CCRC received an application for review of the conviction in May 2006.

During review, the CCRC obtained fresh evidence relating to the credibility of a key prosecution witness.

At trial, this witness had told the court that she had not seen another man who was alleged to have taken part in the offence. She also stated that she did not know his whereabouts.

The witness had, in fact, married this man after the alleged offence.

The CCRC concluded this new information raised a real possibility the Court of Appeal would find Mr CF’s conviction to be unsafe.

The CCRC referred the conviction in July 2007.

The Court of Appeal upheld the conviction in February 2008.
