Samuel, Michael

Michael Samuel was convicted in March 2006 of assault occasioning actual bodily harm and making a threat to kill.

Mr Samuel received a sentence of three years’ imprisonment for public protection for assault and five years’ imprisonment for public protection for making a threat to kill. Mr Samuel was given credit for 189 days spent on remand.

The CCRC received an application for review of Mr Samuel’s sentence in May 2007.

Following review, the CCRC concluded that the sentencing judge had been misled by Crown counsel who had told the judge that Mr Samuel had served 189 days on remand.

In fact, Mr Samuel had spent 250 days on remand and the judge had clearly intended Mr Samuel be given credit for the full time spent on remand.

The CCRC referred the sentence in July 2007.

The Court of Appeal reduced the sentence in November 2007 to reflect time spent on remand.
