Mr BU

Published:

Mr BU was convicted in September 1995 of indecent assault and received a sentence of nine months’ imprisonment.

The CCRC received an application for review of the conviction in February 2005.

During review, the CCRC obtained new witness evidence. The witness stated that the complainant had informed her that she had lied at Mr BU’s trial and thereby secured the conviction.

In addition, during the CCRC’s investigation the complainant was wanted by the police. The CCRC considered this impacted the complainant’s credibility as a witness of truth and was relevant to her attitude towards the administration of justice.

The CCRC referred the conviction in February 2007.

The Court of Appeal quashed the conviction in April 2007.
