Gerald, Clovis

Clovis Gerald was convicted in February 1987 of conspiracy to cause grievous bodily harm with intent. Mr Gerald received a sentence of five years’ imprisonment.

The CCRC inherited an application for review of the conviction from the Home Office in March 1997.

Following review, the CCRC found that during the police investigation of the case there had been a significant breach of section 58 of the Police and Crime Evidence Act 1984 in refusing Mr Gerald access to a solicitor during his interview without reasonable grounds for doing so. The CCRC considered this rendered the trial proceedings unfair.

The CCRC referred the conviction in February 1998.

The Court of Appeal upheld the conviction November 1998.
